Acceptable Use Policy

1. Overview

This Acceptable Use Policy ("AUP") governs the use of all products and services provided by Daak Harkara LLC ("Daak Harkara", "we", "our", "us"), including DaakMailer and any future product released under the Daak Harkara brand (collectively, the "Services"). By accessing or using the Services, you agree to comply with this AUP. Violations may result in suspension or termination of your account.

2. Prohibited Content

You may not use the Services to store, send, transmit, or promote content that:

• Violates any applicable law, regulation, or third-party right.
• Infringes copyright, trademark, patent, trade-secret, or other intellectual-property rights.
• Is fraudulent, deceptive, or misleading.
• Contains malware, viruses, ransomware, or other malicious code.
• Is defamatory, harassing, threatening, or invasive of another person's privacy.
• Promotes hate, discrimination, or violence against any individual or group.
• Sexually exploits or endangers minors in any way (we report all such content to relevant authorities).
• Constitutes phishing or social engineering.
• Distributes pirated software, media, or unauthorized copies of copyrighted works.
• Contains personally identifiable information (PII) of others without lawful basis or consent.

3. Prohibited Activities

You may not use the Services to:

• Send unsolicited bulk email or messages (see our Anti-Spam Policy for details).
• Bypass, disable, or interfere with security or authentication features.
• Probe, scan, or test the vulnerability of any system or network without written authorization.
• Engage in denial-of-service (DoS), distributed denial-of-service (DDoS), or any other attack against any network or system.
• Use automated tools (bots, scrapers, crawlers) to access or extract data from the Services beyond what is permitted by published API rate limits and the Terms of Service.
• Reverse-engineer, decompile, or disassemble any portion of the Services, except to the extent expressly permitted by applicable law.
• Resell, sublicense, or repackage the Services without explicit written permission.
• Mine cryptocurrency or run resource-intensive workloads unrelated to the intended use of the Services.
• Create multiple accounts to evade limits, abuse free trials, or circumvent suspensions.
• Misrepresent your identity or affiliation with any person or organization.
• Interfere with another customer's use of the Services.

4. Email-Specific Rules

If you use DaakMailer or any messaging-capable Service, you must also comply with our Anti-Spam Policy. In particular:

• Only send to recipients who have given express, verifiable consent.
• Provide a clear, working unsubscribe mechanism in every marketing message.
• Honor unsubscribe requests within 10 business days.
• Never use purchased, rented, scraped, or harvested email lists.
• Identify yourself accurately in the From, Reply-To, and physical-address fields.
• Comply with CAN-SPAM (US), CASL (Canada), GDPR (EU/UK), and any other applicable laws in your recipients' jurisdictions.

5. Reporting Abuse

If you believe a Daak Harkara customer is violating this AUP, report it to abuse@daakharkara.com (or security@daakharkara.com). Include the offending content (with full email headers if applicable), the affected account or domain, and your contact information. We acknowledge every credible report within 24 hours on business days and investigate promptly.

6. Enforcement

We may, at our sole discretion and without prior notice when warranted by the nature of the violation, take any of the following actions in response to a violation of this AUP:

• Issue a warning and request remediation.
• Suspend or rate-limit specific Service features.
• Suspend or terminate the account.
• Remove or disable access to the offending content.
• Withhold pending payouts or refunds where the violation involves fraud or chargebacks.
• Cooperate with law enforcement and disclose information as required by law or valid legal process.

We reserve the right to take any other action we deem appropriate to protect the Services, our customers, our partners, and the public.

7. Changes to This Policy

We may update this AUP from time to time to reflect changes in our Services, applicable law, or threat landscape. Material changes take effect on the "Last updated" date shown above. Continued use of the Services after the effective date constitutes acceptance of the updated AUP.
