Anti-Spam Policy

1. Our Commitment
Daak Harkara LLC has zero tolerance for spam. Our products — especially DaakMailer — are built for legitimate, permission-based communication only. This Anti-Spam Policy describes the standards every customer must meet when using our messaging services. It is part of our Acceptable Use Policy and Terms of Service; violations may result in immediate suspension or termination.
2. Compliance with Law
You are responsible for ensuring that your use of our messaging services complies with all applicable laws in your jurisdiction and in the jurisdictions of your recipients, including:
- CAN-SPAM Act (United States)
- CASL — Canada's Anti-Spam Legislation
- GDPR and the ePrivacy Directive (European Union, United Kingdom)
- Spam Act 2003 (Australia)
- Any other applicable national or local anti-spam, privacy, or telecommunications law.
3. Consent (Permission to Email)
You may only send marketing or commercial messages to recipients who have given you express, verifiable consent to receive them. Acceptable forms of consent include:
- A clear, affirmative opt-in (checkbox unchecked by default) on a sign-up form.
- A confirmed (double) opt-in via email confirmation link.
- An existing direct customer relationship where the recipient reasonably expects to hear from you about related products or services.
You must keep records of when and how each recipient gave consent and be able to produce them on request.
4. Prohibited List Sources
You may not send messages to addresses obtained from any of the following:
- Purchased, rented, or leased email lists.
- Lists scraped or harvested from websites, social media, or any other public source.
- Lists exchanged or shared with another business without re-consent.
- Lists where consent cannot be reliably documented.
- Role addresses (info@, sales@, postmaster@, etc.) without an existing direct relationship.
- Addresses obtained from data brokers.
5. Required Message Content
Every marketing message you send through our Services must:
- Identify the sender accurately in the From and Reply-To fields. No misleading sender names.
- Use a non-deceptive subject line that accurately reflects the message content.
- Include a clear, working unsubscribe mechanism in every message — typically a one-click unsubscribe link.
- Include a valid postal address for the sending business.
- Disclose the commercial nature of the message where required by law.
- Honor unsubscribe requests promptly — within 10 business days at the latest, and immediately wherever possible. Once unsubscribed, do not re-add a recipient without fresh, verifiable consent.
6. Bounces, Complaints, and List Hygiene
You are responsible for maintaining good list hygiene. We monitor sending performance and may suspend accounts that exhibit:
- Hard-bounce rate above 5% in any campaign.
- Spam-complaint rate above 0.1% (1 complaint per 1,000 recipients) in any campaign.
- Repeated hits on industry spam-trap addresses.
- Listing on major blocklists (Spamhaus, SpamCop, Barracuda, Microsoft, Google, etc.).
- Sudden, large list uploads that cannot be matched to consent records.
We may rate-limit, pause, or terminate accounts that exceed these thresholds, and we will work with you to remediate before re-enabling sending.
7. Authentication
You must configure proper email authentication for any sending domain you use through DaakMailer:
- SPF — listing our sending IPs in your DNS.
- DKIM — signing your messages with a key we provision.
- DMARC — published policy aligned with SPF/DKIM.
We provide tooling and documentation to help you set these up. Sending from unauthenticated domains may be blocked at our edge.
8. Reporting Spam
If you received a message you believe was sent through our platform in violation of this policy, please report it to abuse@daakharkara.com with the full message including all headers. We investigate every credible report within 24 hours on business days.
9. Enforcement
We may, at our sole discretion, suspend or terminate any account that violates this Anti-Spam Policy. In the event of repeated, willful, or egregious violations, we may also report the violator to relevant authorities, ESP industry blocklists, and law enforcement. We do not refund subscription fees for accounts terminated for spam violations.
10. Updates
We may update this Anti-Spam Policy from time to time as laws change or industry best practices evolve. Material changes take effect on the "Last updated" date shown above.
